PROGRESSIVE UNDERLAYMENT WARRANTY

Warranty terms. Warranty covers returns made within 48 hours (two business days) of the purchase and reported to Hawaii Progressive Flooring in writing, only to supply new material of the same or similar grade sufficient to replace of defective material. Hawaii Progressive Flooring will not pay labor costs or the cost to repair or replace materials with defects that were apparent at the time of installation or beforehand. No replacement will be made to products that have been subjected to abuse. Improper maintenance, vandalism, alteration; or damage caused by smoke, fire, flood, wind, lightening, or any other casualty event.

Providing that Progressive Underlayment  is used in a normal setting, under normal traffic conditions and with proper care and maintenance, Hawaii Progressive Flooring warrants that from the date of the original installation the Progressive underlayment 2mm and 3 mm EVA will not wear through for the period specified by the warranty level of the product purchased. Please inquire with a sales manager regarding the warranty wear period for each product separately.

Exclusions the following are not covered by this limited warranty: improper installation; differences in color between products and samples or photograph, inappropriate end user activities. There are no warranties beyond this expressed limited warranty. All other warranties of merchantability are excluded.

Maui grade LLC, dba: Hawaii Progressive Flooring excludes any liability for lost profits or any other indirect, special or consequential damages.

This warranty excludes all casualty events involving water coming in contact with your floor and failures normally covered by homeowners insurance (such as water from fires) including, but not limited to, damages caused by flooding or standing water from leaking pipes, faucets, or household appliances. This limited warranty does not apply to damage caused by water or moisture in the subfloor or underneath the flooring, including, but not limited to, damage from the subfloor hydrostatic pressure or other conditions that result in water or moisture being under the floor.  It is the responsibility of the installer/homeowner to determine if the job site conditions, environmental conditions and sub-floor are acceptable for the installation. Prior to installation, the installer/owner must determine that the jobsite meets or exceeds all applicable National Wood Flooring Association’s Installation Guidelines.

These limited warranties exclude progressive underlayment 3mm and 2mm  that has been put to abnormal use or conditions or abused in any way. “Abnormal use or conditions” includes, but is not limited to, water damage from plumbing, storm or flood; damage from smoke or fire; or other accidents and casual events. These limited warranties do not cover indentations, scratches, stains; or damage caused by negligence, pebbles, sand, or other abrasives; pets, narrow or spike heeled shoes, cleats or boots, insufficient furniture protection, casters on furniture, rotating beater bars on vacuum cleaners, burns, cuts, dropping heavy/sharp objects, appliance leaks, damage caused by steam mops; or improper alterations of the original manufactured product. “Abuse” is any use of the underlayment   that is unreasonable considering the normal and expected uses of flooring underlay  in a residence. These limited warranties do not apply to damages from exposure to extreme heat, dryness or water saturation; or stains as a result of chemical or industrial. Controlling flooring moisture content is important for success.

 

This limited warranty is not transferable by the Warranty Holder to any other party, including but not limited to a subsequent purchaser of the building in which the underlay  is installed. How to Obtain Warranty Service: The Purchaser must inspect the underlayment  for Manufacturing Defects and report any such defects to Hawaii Progressive Flooring, prior to installation of the underlay. To obtain warranty service, the Purchaser must contact Hawaii Progressive Flooring at Hawaiianflooring@gmail.com or 808-517-3709. To be covered under this limited warranty, the Purchaser must provide documentation of sales order and proof that the underlayment was properly installed.

THIS IS THE COMPLETE WARRANTY AND IT IS IN LIEU OF ALL OTHER EXPRESS OR IMPLIED WARRANTIES AND CONDITIONS OF EVERY KIND, WHETHER CONTRACTUAL OR STATUTORY, ALL OF WHICH ARE DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY LAW. Some states do not allow limitations on the duration of an implied warranty, so the above limitation may not apply to you. This warranty gives you specific legal rights, and you may also have other rights that vary from state to state. Limitation of Damages: IN NO EVENT SHALL HAWAII PROGRESSIVE FLOORING BE LIABLE UNDER THIS WARRANTY FOR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES EVEN IF HAWAII PROGRESSIVE FLOORING HAS BEEN INFORMED, OR SHOULD BE AWARE, OF THEIR LIKELIHOOD, OR FOR ANY OBLIGATIONS OR DAMAGES OTHER THAN THE SPECIFIC WARRANTY SERVICE OBLIGATIONS EXPRESSLY SET OUT ABOVE. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
